ELETRK Rental Agreement & Renter Waiver

1. PARTIES

This Agreement is between Eletrk (eletrk.com), the Bike Owner (the individual or business that listed the bike), and the Renter (you). Eletrk acts solely as a marketplace and does not own any bike listed on the platform.

2. REFUND POLICY

• Cancellations more than 24 hours before rental start time: full refund
• Cancellations less than 24 hours before rental start time: no refund
• No-shows: no refund
• If the Owner cancels: full refund within 5 business days
• Disputes must be submitted through eletrk.com within 48 hours of rental end

3. OPERATING RULES

By renting you confirm you will follow all rules below at all times:

• You must be 18 years of age or older to rent
• You must wear a helmet at all times while operating the eBike
• You must obey all Florida traffic laws, local ordinances, and bike path regulations
• You must not ride on highways or roads where bicycles are prohibited
• You must not operate the eBike under the influence of alcohol or drugs
• You must not carry passengers unless the listing explicitly states the bike supports it
• You must not allow any other person to operate the rented bike
• You must keep the bike locked and secured when not in active use
• You must return the bike on time and in the same condition you received it
• You must not modify, tamper with, or attempt to repair the eBike
• You must not use the eBike for racing, stunts, or any commercial purpose

4. DAMAGE, LOSS & LATE RETURNS

• You are fully responsible for any damage, loss, or theft of the bike during your rental
• Damage charges will be assessed by the Owner and billed to your payment method on file
• Late returns will be charged at the hourly rate shown at time of booking
• Failure to return the bike within 2 hours of the agreed time without notice may be reported to authorities as theft
• Eletrk may charge your payment method for any valid damage or late fee claims

5. NO INSURANCE PROVIDED

Eletrk does not provide personal injury insurance, health insurance, or property damage insurance of any kind for Renters. You are solely responsible for obtaining any insurance coverage you require before renting.

6. WAIVER OF LIABILITY & ASSUMPTION OF RISK

THIS SECTION LIMITS YOUR LEGAL RIGHTS. READ CAREFULLY.

Renting an eBike involves inherent risks including personal injury, death, property damage, mechanical failure, road hazards, and weather conditions. By accepting this Agreement you voluntarily assume all such risks.

To the fullest extent permitted by Florida law, you WAIVE, RELEASE, AND DISCHARGE Eletrk, its officers, employees, and agents, and the bike Owner, from any and all claims, damages, or liability arising out of your use of the rented eBike — including claims based on negligence — except in cases of gross negligence or willful misconduct.

7. ELETRK'S ROLE — MARKETPLACE ONLY

Eletrk is a technology marketplace that connects bike owners with renters. Eletrk does not own, inspect, maintain, or guarantee the condition of any listed bike. Eletrk is not liable for any injury, loss, or damage arising from the condition of a listed bike.

8. GOVERNING LAW & DISPUTES

This Agreement is governed by the laws of the State of Florida. Any disputes shall be resolved through binding arbitration in Palm Beach County, Florida, under American Arbitration Association rules. You waive the right to participate in any class action against Eletrk.

9. ELECTRONIC ACCEPTANCE

Checking the "I agree to the Rental Agreement" box at checkout on eletrk.com constitutes a valid and legally binding electronic signature under the E-SIGN Act (15 U.S.C. § 7001) and Florida's Electronic Signature Act (Fla. Stat. § 668.50). You confirm you have read, understood, and agree to every term in this Agreement.
